These terms explain Toyota Camroad Australia’s policy for vehicle holding deposits and vehicles sourced through our Special Order Program.

For the purposes of these terms, Toyota Camroad Australia means the licensed motor dealer identified as the seller in the relevant written vehicle sale contract or Special Order Agreement.

These website terms should be read together with any written vehicle sale contract, Special Order Agreement, Private Order Pack, quotation or other document signed by the customer.

Where a signed written agreement applies to a particular transaction, that agreement will govern the transaction to the extent permitted by law.

Nothing in these terms is intended to exclude, restrict or modify any right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

1. Fully Refundable Holding Deposits

Unless a vehicle is being purchased through our Special Order Program or different written terms have been agreed, a deposit paid to reserve or hold a Toyota Camroad is:

• 100% refundable 
• refundable at the customer’s request 
• not subject to a cancellation fee or administration fee 
• refundable regardless of a change of mind. 

This policy applies to deposits placed on vehicles including:

• current dealership stock 
• vehicles awaiting shipping 
• vehicles in transit to Australia 
• other standard dealership vehicle reservations. 

A holding deposit does not, by itself, require the customer to complete the purchase.

Once the customer enters into a formal written vehicle sale contract, the terms of that contract and any applicable statutory requirements will apply.

2. Refund Requests

A customer wishing to cancel a standard vehicle reservation should contact Toyota Camroad Australia by phone, email or in writing.

Once the refund request has been received and confirmed, we will arrange the refund promptly.

Refunds will normally be returned using the same payment method used to make the deposit unless another method is agreed.

Banking or payment-provider processing times may apply.

3. Vehicle Availability

We make every reasonable effort to keep vehicle availability information accurate.

A vehicle may occasionally become unavailable before a sale is completed. If that occurs before a binding sale contract has been completed, any standard holding deposit paid will be refunded in full.

Toyota Camroad Australia’s Special Order Program is designed for customers who want a Toyota Camroad sourced specifically around their preferred model, year, layout, specification and intended use.

Special Order vehicles are sourced specifically for the individual customer and therefore operate differently from ordinary dealership stock reservations.

Special Order vehicles are generally supplied on a full payment up-front basis.

Before sourcing begins, the customer must:

• complete and sign the required Special Order documentation 
• provide the information reasonably required for the order 
• confirm their agreed model, year range, layout and important requirements 
• provide cleared funds in accordance with the written Special Order Agreement. 

Toyota Camroad Australia will not commence sourcing until the required documentation and cleared funds have been received.

For the purposes of these terms, sourcing commences when Toyota Camroad Australia, specifically for the customer’s order:

• enters into a binding commitment to acquire or reserve a vehicle; or 
• incurs a non-cancellable financial commitment connected with acquiring the vehicle, 

and Toyota Camroad Australia confirms to the customer in writing that sourcing has commenced.

Until sourcing has commenced, a customer may cancel their Special Order and receive a refund of cleared funds paid, unless different written terms have been expressly agreed.

A Special Order vehicle is sourced using the requirements recorded in the customer’s signed Special Order documentation.

These may include:

• preferred model 
• year or year range 
• drivetrain 
• layout 
• kilometre range 
• important equipment or features 
• budget. 

Availability in Japan varies continuously.

Unless expressly agreed in writing, Toyota Camroad Australia does not guarantee that a particular individual vehicle will be available.

Where a particular requirement is essential to the customer, it should be clearly identified as a must-have requirement in the written Special Order documentation before sourcing commences.

Importation, shipping, Australian compliance, regulatory processes and vehicle preparation can involve circumstances outside Toyota Camroad Australia’s direct control.

Unless a specific date has been expressly guaranteed in writing, Toyota Camroad Australia does not guarantee:

• a specific sourcing date 
• a specific shipping date 
• a specific arrival date 
• a specific compliance completion date 
• a fixed handover date. 

We will keep the customer reasonably informed as the vehicle progresses through the process.

Typical updates may include:

• vehicle secured 
• shipping arranged 
• vehicle in transit 
• vehicle arrived 
• compliance underway 
• preparation underway 
• ready for handover. 

If Toyota Camroad Australia is unable to complete the agreed Special Order because:

• a suitable vehicle cannot reasonably be sourced 
• the secured vehicle materially fails an agreed must-have requirement 
• the vehicle cannot lawfully be imported, complied or supplied 
• or Toyota Camroad Australia is otherwise unable to perform the agreed supply, 

we will discuss the available options with the customer.

Those options may include:

• continuing the search 
• agreeing on a suitable alternative vehicle 
• varying the Special Order requirements by mutual agreement 
• cancelling the Special Order. 

If the Special Order is cancelled because Toyota Camroad Australia cannot complete the agreed supply and the customer has not agreed to an alternative, the customer will receive a refund of the amounts paid in accordance with applicable law and the written Special Order Agreement.

Once sourcing has commenced, Toyota Camroad Australia may already have entered into binding financial commitments specifically for the customer’s vehicle.

If the customer subsequently changes their mind or decides not to continue with the transaction, the customer should contact us immediately.

Amounts already irrevocably committed or reasonably incurred in sourcing the vehicle may not be recoverable.

Any amount retained following a customer cancellation will be limited to amounts reasonably connected with the Special Order transaction and Toyota Camroad Australia’s actual commitments, costs or losses, to the extent permitted by law.

Depending on the circumstances, the committed amount may be substantial because Toyota Camroad Australia may already have committed to or purchased the vehicle specifically for the customer.

Any balance not reasonably required for those purposes will be returned to the customer.

Nothing in this clause affects any rights or remedies available to the customer under the Australian Consumer Law.

If the customer’s circumstances change after a Special Order vehicle has been secured, purchased or imported, possible options may include:

Option 1 — Complete the Purchase and Take Delivery

The customer may proceed with the transaction and take delivery of the vehicle in accordance with the agreed terms.

Option 2 — Complete the Purchase and Sell the Vehicle Independently

The customer may complete the transaction and subsequently sell the vehicle themselves.

Option 3 — Separate Agency or Consignment Resale

At Toyota Camroad Australia’s discretion, we may agree to assist with resale of the vehicle under a separate written agency or consignment arrangement.

Any such arrangement is separate from the original Special Order transaction and will set out:

• appointment terms 
• selling price or agreed owner return 
• commission or fees 
• advertising and selling arrangements 
• settlement arrangements. 

Where Queensland consignment requirements apply, the appropriate written appointment will be completed and buyer funds will be handled through the required trust-account process.

The availability of this option is not guaranteed and depends on a separate written agreement being entered into.

Unless otherwise stated in the written quotation or Special Order Agreement, a Special Order may include:

• sourcing of the agreed Toyota Camroad 
• importation arrangements 
• Australian compliance arranged for the vehicle 
• professional preparation for handover 
• Queensland registration where applicable 
• warranty coverage applicable to that vehicle 
• vehicle documentation and handover support. 

The exact inclusions for each vehicle will be set out in the customer’s written quotation or Special Order documentation.

Toyota Camroad Australia is a Queensland dealership and vehicles are supplied under the documentation and registration arrangements applicable to the Queensland transaction.

Where Queensland registration is included, interstate customers are responsible for completing any transfer, inspection, registration or state-specific requirements that apply in their home state or territory.

Registration, inspection, engineering and certification requirements can vary between Australian states and territories.

Queensland inspection, compliance or registration documentation may not satisfy every requirement imposed by another state or territory.

Interstate buyers should confirm their local requirements before taking delivery.

Toyota Camroad Australia will provide the vehicle documentation we hold and will assist reasonably where possible.

Prices displayed on the website for Special Order vehicles are indicative unless a fixed written quotation has been provided.

Pricing can vary depending on factors including:

• model and year 
• kilometres 
• drivetrain 
• vehicle condition 
• layout and specification 
• equipment and options 
• availability at the time of sourcing 
• shipping and import costs 
• compliance requirements 
• preparation requirements. 

Any stamp duty, transfer costs, inspections or other state-specific charges not expressly included in the quotation remain the customer’s responsibility.

The precise specification and inclusions of each vehicle will be set out in the relevant written agreement.

Queensland motor vehicle transactions are completed under a written vehicle sale contract.

When the customer and Toyota Camroad Australia enter into a signed vehicle sale contract or Special Order Agreement, that document forms the contractual basis of the transaction.

If there is any inconsistency between general information on this website and the signed written agreement for a particular vehicle, the signed written agreement will apply to the extent permitted by law.

Nothing in these terms is intended to exclude, restrict or modify:

• consumer guarantees 
• statutory warranty rights 
• rights arising from misleading or deceptive conduct 
• rights relating to unfair contract terms 
• or any other right or remedy 

that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.
